Amanda Bynes will not be charged with driving under the influence (DUI).

The troubled actress was arrested in the early hours of September 28 2014 but the Los Angeles City Attorney's Office have now opted not to press charges but "after much deliberation and review", her case is being forwarded along to the L.A. County District Attorney's Office as a possible probation violation.

City Attorney's Office spokesman Frank Mateljan told E! News: "As you know, she is currently on probation to the Los Angeles District Attorney's Office for a 2012 DUI out of Beverly Hills.

"The matter was referred yesterday. No further action [in our office] is scheduled on this matter."

The 'She's the Man' star's arrest came just six months after she had got her driving license back after it was suspended by the Department of Motor Vehicles (DMV) in September 2012 following two alleged hit-and-run incidents that year, though the charges were later dismissed.

The 'Hairspray' actress was also charged with DUI in April 2012 after she hit a police car in West Hollywood, but the charge was dropped in February 2014 and she was sentenced to three years of probation for reckless driving as part of a plea deal.

The DMV restored her licence last April following three months of alcohol education classes as part of her plea deal.

The plea deal came at a time when Amanda seemed to be getting her life back on track, but just weeks afterwards she was involuntarily committed to a

psychiatric treatment facility in Pasadena, California and placed back under a conservatorship, of which her parents are in control.
