    Dollar store sold choking hazards: Comcom

    A low-price retailer has been found guilty of selling toys with choking hazards for young children and pyjamas without fire danger warnings.


    A low-cost retailer has been found guilty of selling thousands of toys and pyjamas without the appropriate safety labelling.

    The chain 123 Mart was found guilty of 17 charges under the Fair Trading Act for not adhering to compulsory safety standards for children's toys and sleepwear in the Auckland District Court.

    Approximately 9000 units of seven different types of toys with small parts that presented choking hazards for young children were sold, Judge Robert Ronayne says.

    It had earlier pleaded guilty to five charges over the sale of 1200 children's sleeping pants which lacked the required fire danger labels and more than 11,000 items of clothing that didn't comply with labelling requirements for care, origin and content.

    The Commerce Commision says it investigated the retailer three times and laid charges after 123 Mart was warned in 2013.

    There are 60 stores nationwide under the names The 123 Mart, Dollar Store 123, King Dollar Store and Max!Out.

    All the non-compliant products have been taken off shelves.

    Sentencing will take place in October.
