Harvey Weinstein is set to have a showdown with the Weinstein Company's Board of Directors on Tuesday (17.10.17)

The disgraced movie mogul is currently in Arizona receiving treatment for sex addiction and behavioural issues, but will connect to the meeting via speakerphone and will have representation in the form on his civil lawyer, Patty Glaser as the ex ecutives, including brother Bob Weinstein, discuss his recent firing in the wake of sexual misconduct allegations.

Sources told TMZ the company never offered Weinstein or his lawyer a reason for his firing, and so his legal representative is planning to outline multiple reasons why his dismissal violates his contract.

It was previously revealed there was a provision in the contact which covered claims such as sexual harassment, and states that if Weinstein reimburses the company for any settlement and then pays a penalty, all is fine, and Glaser plans to note the contract was signed in October 2015, and there hasn't been a single claim against him since.

However, O'Melveny and Myers, the lawyers who represent The Weinstein Company, believe the firm had every right to fire the producer because he violated their Code of Conduct.

But insiders revealed Glaser believes the contract trumps the code, and if the board won't agree with her - which is said to be unlikely - she can try to force mediation and arbitration, and is ready to file a lawsuit, something which the company wouldn't want.

The source said: "There is so much c**p that will be unearthed in a lawsuit, the company just can't survive it."

Bob recently admitted he is calling for Harvey's ownership interest in The Weinstein Company to be severed.

Referring to Harvey's plan to fight his firing, Bob said: "Anybody can do what they want to do. I cannot control other people's actions. But he was fired by the board, okay? I was on that board. I fired him. He can fight. It will be a losing fight ...

"That is correct [that he has ownership interest in the company] and we are going to seek to sever that. It can't be done that quickly. But I am on it 24/7 and so is David Glasser and so is the board of directors that remain and so are the shareholders. This is being dealt with."

And Bob is adamant that he wants to make a "separation" between the company and Harvey.

He added: "There have been men and women, actresses, actors, directors, but especially women I would say, who are so properly disgusted with my brother's actions. Their attitude is when there is finally the entire divorce, when there's the plan in place, when there is the separation in place ...

"I have a reputation that's different than Harvey, obviously, and I work differently than him. And David Glasser is his own man. We have our own status in the industry. And they're saying we will give the two of you a chance. You have to make the separation. [With] my brother having contractual financial rights in this company, the divorce is going to be as speedy as we can make it. It's in process."
