Man claiming three times over legal breath alcohol limit caused by mouthwash fails in second appeal
A man who claimed he blew three times over the legal breath alcohol limit because he'd used too much mouthwash has failed in a second bid to quash his sentence
19 December 2018
Paul Blair claimed his 761 micrograms of breath alcohol reading was due to his "liberally" applying an alcohol-based mouth gel to his mouth plate some 45 minutes before getting busted.
However, the court found there was no basis for his argument.
His conviction stands.
