Mariya Taylor has to pay Robert Roper almost 28-thousand dollars in legal costs.
Taylor alleges Roper sexually harassed her and locked her in a cage in the 1980s.
She sought financial damages for mental harm.
A judge found it was "likely" Roper had committed the offences - but dismissed the case because it wasn't taken to court within the necessary time-frame - and granted Roper costs..
Taylor's lawyer Geraldine Whiteford says rules need to be reconsidered to ensure survivors of sexual abuse in this position are not further victimised.
