The High Court case stems from 2014 book, Dirty Politics, and is in relation to claims he took money to write blog posts attacking health professionals.
Slater, who had a stroke in November, has been told by the Auckland High Court his bankruptcy doesn't affect his obligation to obey court orders.
Instead, he has to prove he is too unwell to turn up to court to answer questions.
In the latest judgment, Justice Matthew Palmer tossed out a claim Slater's recent bankruptcy meant he had no part to play in the defamation case.
