The Rabbitohs player, who is just coming off a one-week ban, called the current system a 'Kangaroo Court' and called for an overhaul of the process to prevent players missing big games.
In response the NRL has advised Burgess that he must explain why he shouldn't be issued with a breach notice for the comments.
All players are bound by the NRL Code of Conduct which prohibits a player from commenting adversely on the judiciary.
Burgess has agreed to meet NRL Chief Executive Todd Greenberg to discuss the situation.
