It comes after the Advertising Standards Authority ordered Unilever to remove an ad outside a Whangarei dairy, stating "ice cream makes you happy".
It ruled the ad could undermine the health of consumers.
AUT senior marketing lecturer Crystal Yap says it's unacceptable.
She says they're trying to create deceptive belief, because there's no scientific evidence that associates ice cream with happiness.
Global ice cream chain Ben and Jerry's is also facing a lawsuit over a claim its products come from 'happy cows.'
