    Emergency does not create power .


    That's the opening argument from Wellington Lawyer Andrew Borrowdale, who's seeking a judicial review into the legality of the lockdown.

    Today is the first of a three-day hearing in the High Court at Wellington.

    Borrowdale's lawyer -- Tiho Mijataov -- says if it's law ... it will be found in our books.

    If it's not there, it's not law.

    If the court rules there was no legal basis for the lockdown, it could throw into question any arrests made during that period.
