Clinton Thinn strangled his prison cellmate Lyle Woodward to death in a San Diego jail using a ripped cloth ligature in December 2016.
The step-brother of the former National Party deputy leader was convicted of first degree murder.
Thinn was awaiting trial for a bungled bank robbery at the time of the killing, after travelling to the US to pursue his fledgling rap career.
The judge in the appeal case says Thinn's decision not to take the stand in his own defence effectively sealed his fate with the jury.
