David Charteris was sentenced in September 2019, on eight charges of sexual violation and indecent assault on a boy from 1999.
His lawyer argued today there was a miscarriage of justice during the trial over a cross examination about whether Charteris was circumcised.
He also claims there was a delay when the boy revealed the sex offending to family, and Charteris was given little leeway over his memory of when contact ended.
The Crown argued there was no injustice to the overall decision and the defendant's narrative often changed.
Justice Nation has reserved his decision.
