Consents for the building were issued more than a decade ago, but engineers who reviewed it during the building consent process raised several concerns, including its elasticity in an earthquake.
The council says questions raised at the time by the reviewing firm were worked through and settled.
But Spencer Holmes rejects that - saying it grossly misrepresents their position and the council issued building consent against its advice.
