Erika Jayne claims her estranged husband Tom Girardi is yet to divorce her because he is "incompetent"

The Real Housewives of Beverly Hills star, 54, initially filed for divorce from Tom, 86, in November 2020, and the pair were later sued for embezzlement.

It was later found Erika didn't participate in "any wrongdoing", but Girardi was sentenced to seven years in federal prison in June.

During an appearance on Watch What Happens Live this week, Erika was asked by a fan why she "hadn't filed for divorce", but she clarified: "Oh, I have! You guys have got it so wrong.

"Yes, of course I have. I filed for separation.

"It's very difficult to get someone who's incompetent to divorce.

"I have to ask the conservator. It's just not that easy. You guys, just stop with all that.

    "Chill on that."

But Erika has no plans to see Girardi anytime soon.

Asked if she had thought "at all about seeing him", she replied: "I have ... no.

    "It's just too much.

"That's enough. He's done. It is what it is."

Six months ago, former attorney Girardi was handed an 87-month jail term for embezzling tens of millions of dollars of settlement money that belonged to his clients, some of whom awaited payment for treatment of severe physical injuries.

United States District Judge Josephine L. Staton also ordered Girardi to pay a $35,000 fine and $2,310,247 in restitution.

United States Attorney Bill Essayli said: "This self-proclaimed 'champion of justice' was nothing more than a thief and a liar who conned his vulnerable clients out of the millions of dollars.

"My office will vigorously prosecute corrupt lawyers and those who assist them in criminal activities."

In 2022, Judge Richard Fruin found there was no evidence Erika participated in "any wrongdoing".

Speaking to MailOnline, she said: "It's a good day."

When asked if she felt "vindicated" by the court ruling and she replied: "Yes, I do."

And when quizzed on what she would say to her critics, she added: "All I asked for was some time and some understanding. And today is a good day."
