The Supreme Court's ruled a Court of Appeal decision that ultimately eased the test for Maori to gain customary rights for use of the foreshore and seabed - was a majority error

The just-issued ruling allows the Attorney-General to appeal the decision made in October last year.

Customary marine title let Maori give or refuse permission for certain activities that require a resource consent.

The new ruling has found the Court of Appeal took a narrow approach - and the Supreme Court says it's allowing the Attorney-General's appeal, to better reflect the purpose of the Marine and Coastal Area Act .
