Open Justice reports the court has referred his case to the Family Court - for a decision.
The man was ordered into care after he smashed a neighbour's windows with an axe in 2004, because of the risk posed to himself and the wider community.
He's been detained at Auckland's Mason Clinic under the Intellectual Disability Compulsory Care and Rehabilitation Act.
His lawyer argues the detention is arbitrary and breaches his human rights.
