Sofia Vergara's ex-fiancé allegedly filed lawsuit to prevent her from destroying their embryos

Nick Loeb reportedly claims he and the 'Modern Family' actress, who previously revealed she is unlikely to get pregnant naturally after successfully battling thyroid cancer, created and froze two cryopreserved female embryos using his sperm and her eggs to use for In Vitro Fertilization (IVF) six months before they split last May, and wants to save them as he believes "life begins at conception."

The entrepreneur filed court documents under the pseudonym John Doe in California on April 1, seeking "to ensure that the female embryos are not destroyed, but Jane Doe [Sofia] refuses to agree to their preservation under all circumstances," according to In Touch Weekly magazine.

The publication alleges that the former couple previously had two embryos implanted in a surrogate, but both procedures failed.

An insider added: "Nick has always wanted to be a father and will do whatever it takes to save these two remaining female embryos. Nick is very emotionally invested in these female embryos because he's pro-life and believes life begins at conception."

Nick is also suing the medical facility where the embryos are being stored, claiming they never decided what would happen if he and Sofia split.

The legal papers also claim the 42-year-old actress, who got engaged to 'Magic Mike' actor Joe Manganiello in December and has a 23-year-old son, Manolo, from a previous marriage, "was physically and mentally abusive" to Nick on numerous occasions during their relationship.

Nick originally filed the lawsuit last August, but refiled it with new information earlier this month after obtaining another lawyer.

Sofia recently admitted that she and Joe, 38, are planning to have children, but thinks it will be weird.

She explained: "My son, Manolo, is 23 years old, which is going to be really weird if I have another baby. But, you know, Joe wants babies and if it's going to make him super-happy, then..."
