Open Justice reports Coroner Marcus Elliot has found the variation to the man's bail conditions should never have happened.
Child Youth and Family provided a report at the request of a judge, stating it had no concerns about the man living with his partner and her children.
In 2015, 10 days after moving in - the little boy died from a spinal cord injury.
The Coroner's findings are the second part of an inquest into the baby's death - the first part of which determined the man, who later died in custody, had inflicted the infant's injury.
